Jurisprudence of Domestic Courts in East, West and Southern Africa on the Protection of Human Rights while Countering Terrorism

There have been numerous human rights concerns emanating from the enforcement of anti terror legislation. Many of the anti-terror laws enacted in the region do not meet the necessary criteria to be compliant with international human rights law. Through legislation that often lacks precision and does not meet the principles of legal certainty, necessity and proportionality, governments have adversely affected the enjoyment of human rights and fundamental freedoms.
